The most common causes of train accidents.

Most train accidents involve either cars/trucks colliding with trains, pedestrians or train derailments. Pedestrian accidents, which are almost always fatal, are commonly caused by:

  • A person walking across a double set of tracks to enter or exit a train accidentally steps into the path of an oncoming train
  • A person walks on a path across a railroad track and that path is not clearly marked with warning signals or blockades

This may make you wonder: What causes a train derailment? There are many causes including:

  • A vehicle blocks traffic
  • The train track has not been maintained
  • A dispatcher makes an error, such as putting more than one train on the same track or switching a train to the wrong track
  • The train engineer speeds or otherwise doesn’t work safely

Toxic chemical spills from train derailments can result in burn injuries and toxic inhalation for people who live near railroads and people who work on railroads. A very serious derailment can also require homeowners to evacuate and cause property damage.

These are just some of the common causes of train derailments. At Greg Jackson Law, I will do the necessary work to find the cause of your accident.

There are time limits affecting your ability to file a train accident claim.

Unfortunately, you don’t have an unlimited amount of time to file your train accident claim. Depending on who the defendant is, whether you suffered physical injuries, property damage, or both, and several other factors, you could have as little as six months to file your claim.

Don’t take an insurance adjuster’s word for it when they tell you they are giving you the best possible settlement. They are not on your side. I am. Call Greg Jackson Law at (817) 926-1003 to request a consultation. I am here to help you through this difficult time.
